Jussie Smollett appeared tense during a heated phone call on his Hawaii getaway, telling a pal ‘it’s over, I got off’ after all charges against him were dropped. 

The 36-year-old Empire actor was spotted pacing back and forth during the animated chat and could be heard insisting: ‘I did not do any of this. The charges were dropped.’   

In the footage Jussie, wearing an all black outfit with white sneakers, can be seen walking around a parking lot. An onlooker said: ‘He was saying “Ryan, Ryan. You have to believe me”.’  

The star appeared tense during the conversation, which took place during his family vacation to the islands and came just days after he was pictured all smiles on a trip to the beach.

Smollett’s family were dining in a nearby restaurant during the phone call, according to eyewitnesses.   

It was a stark difference from the pictures last week which showed the actor laughing, chatting to his sisters and unloading a car for a fun-filled day at the beach.

Smollett, his two sisters, brother-in-law and niece and nephew were all spotted at the Kaloko-Honokōhau National Historical Park in Kailua on the Big Island last Wednesday as the fallout from his sensational case raged on in Chicago. 

The actor was last seen flying in to Los Angeles within days of having 16 felony counts of lying to the police dropped after being accused of staging an attack on himself on January 29 to try to get a raise on Empire. 

Police say he paid Abel and Ola Osundairo to beat him in what he then described as a racist, homophobic attack by two Trump-loving perpetrators. He has always maintained his innocence and insisted he was attacked.

The case against him was suddenly and unexpectedly dropped last month by the State’s Attorney’s Office in questionable circumstances.

The legal fallout saw State Attorney Kim Foxx, whose office was in charge of the probe, facing repeated calls to resign over her handling of the case.

Mayor Rahm Emanuel and the Chicago Police Department’s Superintendent Eddie Johnson both expressed their fury when her office decided to drop the case.

She exchanged text messages with members of Smollett’s family in the early stages of the investigation and tried, at their request, to convince the Chicago PD to let the FBI take the lead.

Abel and Ola Osundairo told police he paid them to attack him

Smollett was arrested in February for allegedly lying about the attack. Police say he paid Abel and Ola Osundairo to attack him and that he thought he could use it as leverage to get a raise on Empire, a claim he denies 

Foxx has defended her actions and those of her prosecutors. 

The City of Chicago is now suing Smollett after the actor refused to pay $130,106 worth of overtime that was accrued by police. 

Smollett’s team has never offered an alternative explanation for why the brothers, who he knew and had paid for personal training, would attack him. 

But his lawyer Mark Geragos replied to the city’s letter by claiming its threats were ‘malicious’. It added that he ‘will not be intimidated’ by the city’s demands.
